Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Samado mobile application and related services (the “App”), operated by FAYHE LLC (“Samado”, “we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the App. By using it, you confirm that you meet this requirement.

2. The service

Samado provides personalized running training plans, paces, an AI coach, activity tracking, and related features. We may add, change, or remove features at any time.

3. Health & safety disclaimer

Samado is a fitness product, not a medical device, and does not provide medical advice. The App, including the AI coach, does not replace professional medical, training, or nutritional advice. Consult a physician before starting any training program, especially if you have a medical condition. You participate in physical activity at your own risk. Stop and seek medical attention if you feel pain, dizziness, or discomfort.

4. Accounts

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for activity under your account.

5. Subscriptions & billing

  • Some features require a paid subscription, billed through your Apple App Store account.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription anytime in your App Store account settings.
  • Except where required by law or by Apple’s policies, payments are non-refundable.

6. AI coach

The AI coach generates automated suggestions and may be inaccurate or incomplete. Use your own judgment, and do not rely on it for medical, legal, or emergency decisions.

7. Acceptable use

You agree not to misuse the App, including by reverse-engineering it, interfering with its operation, infringing others’ rights, or using it for unlawful purposes.

8. Intellectual property

The App and its content (excluding your own data) are owned by Samado or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Third-party services

The App integrates with third-party services such as Apple Health, Garmin, and Strava. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Samado shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the App.

12. Indemnification

You agree to indemnify and hold Samado harmless from any claims arising out of your misuse of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time.

14. Apple App Store

These Terms are between you and Samado, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes will be subject to the courts located in the State of Delaware.

16. Changes

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.
